In its decision of 16 July 2020, Case C-311/18 ("Schrems II"), the European Court of Justice (ECJ) declared the European Commission's adequacy decision on the EU-US Privacy Shield (Privacy Shield Decision 2016/1250) invalid. A level of data protection essentially comparable to European data protection standards does not exist for the USA. Consequently, a valid adequacy decision of the European Commission with regard to a transfer
of personal data to the USA within the meaning of Article 45 (1), (3) of the GDPR does not exist. Furthermore, there are no so-called appropriate safeguards within the meaning of Article 46 (2) and (3) of the GDPR. Possible risks of such data transfers without an adequacy decision and
without appropriate safeguards result in particular from the fact that an adequate level of data protection cannot be guaranteed. The provider may have to grant government authorities access to the personal data processed. Personal data may therefore be passed on to third parties who
process or use the data for their own purposes. Data subjects' rights may not be enforced.
